Typically the agent’s authority for the AHCD becomes effective when the covered person’s primary care physician determines that they are unable to make their own health care decisions. With the document, this is typically done by have the doctor sign, on his/her letterhead that this person is in-fact physically or mentally incapacitated.
If a court needs to appointment a conservator, then the agent(s) named in the AHCD will be the nominees for the covered person.
