04 Jun How long does Probate take?
The time it takes to probate an estate varies depending on how complicated the estate is. Things that could complicate an estate include:
• Whether or not the deceased left things in order or not. If the decedent left a mess of papers, receipts, bills, tax returns and the like; it could take months just organizing the estate to prepare for probate.
• Was there at least a will?
• Is there a complex tax problem?
• Many outstanding debts.
• Heirs that can’t be found.
• Lawsuits against the estate.
All these factors being considered, in California a probate takes about 9 months, give or take a couple of months. However if there is a will contest or other lawsuit then it could take years.
